This Service Agreement governs all locksmith services provided by Always Lucky Five Locksmith. By requesting, scheduling, or allowing locksmith services to be performed, the customer agrees to the following terms.
1. Authorization to Perform Locksmith Services
The customer represents and warrants that they are the legal owner, authorized occupant, property manager, tenant, vehicle owner, or authorized agent for the property or vehicle requiring service.
The customer authorizes Always Lucky Five Locksmith to perform locksmith services including but not limited to:
Automotive Services
Vehicle lockout services
Automotive key cutting or duplication
Transponder key programming
Smart key / proximity key programming
Ignition repair or replacement
Broken key extraction
Residential Services
Home lockout services
Lock repair or replacement
Lock rekeying
Deadbolt installation
Mailbox or cabinet lock services
Door hardware installation or adjustment
Commercial Services
Business lockouts
Rekeying of commercial lock systems
Master key systems
Panic bar and door hardware installation
Commercial lock hardware servicing
Emergency Services
Emergency entry services
After-hours lockout assistance
Security access services when immediate entry is required
The customer acknowledges that locksmith services involve manipulation, modification, or forced entry into locking mechanisms.
2. Proof of Ownership and Authorization
For security and legal purposes, customers may be required to provide:
Valid government-issued identification
Proof of ownership or authorization for the property or vehicle
Vehicle registration or insurance documentation
If identification cannot be immediately provided during emergency situations, the customer agrees to provide proof as soon as reasonably possible after service is completed.
Always Lucky Five Locksmith reserves the right to refuse service if proper authorization cannot be verified.
3. Customer Representation
By authorizing locksmith services, the customer affirms that:
They have the legal authority to request access to the vehicle or property.
The requested services do not violate any laws or contractual obligations.
They assume responsibility for any disputes regarding property ownership or access rights.
The customer agrees to indemnify and hold harmless Always Lucky Five Locksmith from any claims arising from unauthorized service requests.
4. Non-Destructive Entry and Potential Damage
Always Lucky Five Locksmith will attempt to use industry-standard non-destructive entry methods whenever possible.
However, the customer acknowledges that:
Some locks or security systems cannot be opened without drilling, decoding, or forced entry.
Certain lock mechanisms may fail during normal service due to wear, age, corrosion, or manufacturer defects.
The customer authorizes the technician to perform any reasonable procedures necessary to complete the requested service.
5. Residential and Commercial Work Disclaimer
For residential and commercial services, the customer understands and agrees that:
Locksmith services may involve removal, adjustment, drilling, or replacement of existing lock hardware.
Some doors, frames, strike plates, or hardware components may require modification to properly install or service locks.
Pre-existing damage, worn hardware, misaligned doors, or improper installation may affect performance of new or serviced locks.
Always Lucky Five Locksmith is not responsible for pre-existing conditions, structural door issues, frame damage, or previously installed hardware failures.
6. Limitation of Liability
To the maximum extent permitted by law, the customer agrees that Always Lucky Five Locksmith shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from locksmith services provided.
This includes but is not limited to:
Property damage resulting from necessary lock entry procedures
Failure of existing locks or security systems
Security breaches unrelated to locksmith work
Loss of property, revenue, or business interruption
The customer agrees that the total liability of Always Lucky Five Locksmith shall not exceed the total amount paid for the services performed.
7. Release of Liability and Waiver of Claims
By requesting and authorizing service, the customer releases, waives, and discharges Always Lucky Five Locksmith, its owners, employees, contractors, and agents from any and all claims, damages, liabilities, or causes of action arising out of or related to the locksmith services performed.
This release applies to:
Automotive services
Residential services
Commercial services
The customer agrees not to pursue any legal claims or actions related to the normal performance of locksmith work authorized under this agreement.
8. Payment Terms
Payment is due immediately upon completion of service unless otherwise agreed.
Prices may vary based on:
Labor time
Vehicle or lock type
Programming requirements
Hardware or replacement parts required
Failure to pay for services rendered may result in collection actions or legal remedies.
9. Right to Refuse Service
Always Lucky Five Locksmith reserves the right to refuse service if:
Proof of ownership or authorization cannot be reasonably verified
The technician believes the request may involve illegal activity
Safety risks are present at the job location
10. Acceptance of Terms
By requesting or allowing locksmith services to be performed, the customer acknowledges that they have:
Read and understood this agreement
Authorized the locksmith work to be performed
Accepted the terms, liability limitations, and waiver of claims
